Latest News of RBI Guidelines for Home Loans 2024

 RBI Saves Repo Rate Unaffected Resulting No Changes in Home Loan EMIs

The Reserve Bank of India has kept the repo rate unaffected for the sixth consecutive time. The repo rate remains the same, i.e., 6.5 per cent which means there will be no changes in the home loan EMIs amount.

The Reserve Bank of India imagines a strong growth of 7 per cent for the Financial Year 2024-25 in the Indian GDP.

RBI Guideline for Home Loans

The Reserve Bank of India (RBI) governs the guidelines for home loan and keeps changing them due to various factors affecting the economy.

 1. Repo Rate

In the 06th consecutive MPC meeting held in the first week of February 2024, the Reserve Bank of India (RBI) announced to keep the repo rate unchanged. The rates were augmented by 25 basis points (bps) in 2023 taking it to 6.5 percent from the earlier 6.25 percent.

 2. LTV (Loan to Value) Ratio

LTV ratio is an assessment of lending risk that all financial institutions, including banks and NBFCs, consider before offering a home loan.

RBI has increased the Loan to Value Ratio up to 90% in case the home loan is below Rs. 30 lakhs. Also, the LTV ratio for loans above Rs. 75 lakhs are up to 75%. Therefore, the higher the LTV value, the easier it would be for an individual to acquisition a property by financing it through a home loan.

Stamp duty and documentation charges will not be included at the time of calculating LTV. Therefore, this reduces the payment of 10% that the home loan borrower is to make upfront.. Also, if the cost of the house is not exceeding Rs. 10 lakhs, banks are allowed to add registration, stamp duty and other documentation charges to the house's cost to calculate the LTV ratio.

 3. Prepayment Charges

A home loan can go up to Rs. 1 crore or even more in some cases, and the maximum tenure goes up to 30 years. RBI has waived off the prepayment charges in case of floating interest rate and has kept the penalty up to 3% in case of a fixed interest rate. Previous, the lenders were asking for a prepayment penalty of up to 5% of the loan amount.

 4. Balance Transfer Facility

Home loan borrowers to refinance their home loan, RBI has waived the foreclosure charges. Home loan borrowers can now easily transfer their current home loan to another bank to avail of a lower interest rate. when the borrower forecloses his home loan from the current bank, he does not have to pay the foreclosure charges.

China Plans to Build Underground Homes Inside Moon

China is trying to get a position in the cosmos. Chinese investigators are now exploring the possibility of starting a long-term, safe and stable shelter on the moon within the lunar lava tubes.

Lunar lava tubes are echoing, pipe-shaped tunnels formed billions of years ago when molten rock flowed beneath the hardened upper layer of lava. Over time, impact events, moonquakes and geological actions have caused the tubes to collapse, forming accessible “skylights” that will provide an entry point to the moon’s underground world.

Zhang Chongfeng presented the study from the Shanghai Academy of Spaceflight Technology at the 10th CSA-IAA Conference on Advanced Space Technology. To better comprehend lunar lava tubes, Zhang and his team, along with Chinese planetary geology specialists, have conducted fieldwork in several lava caverns in China. He added that these lava tubes protect the harsh lunar surface conditions, such as high temperatures, radiation, and micrometeorite impacts.

Good News for Home Buyers Govt to spend Rs 600 billion

29 Sep, 2023

 New Delhi: The Indian Government is seeing spending 600 billion rupees ($7.2 billion) to provide subsidised loans for small urban housing. The government will provide loans over the next five years.

This change will benefit 2.5 million loan applicants from the low-income groups in urban areas. The programme will be applied in the coming months, gaining of crucial state elections later this year and general elections in mid-2024. Gaining of the polls, the South Asian country cut the price of cooking gas for households by about 18% to rein in inflation.

India’s Prime Minister Narendra Modi announced the plan during the country’s Independence Day speech; however, its details were not reported previously.

This is not the first time the government has provided interest subsidies to low-income urban mortgagors. A similar scheme operated from 2017 until 2022, with 12.27 million homes approved.

Tenant Rights in India - If you are a Tenant Know Your Rights

 Your rental agreement will reference a date from which you can live in the house and a date for finish of the contract. This is most often a period of 11 months. Within that timeframe, the landlord cannot forcefully remove a tenant on just his/her urges and notions.

A. Tenant cannot be dispossessed without a valid cause

•          The tenant has not paid rent.

•          The tenant has not followed the landlord’s policies concerning how the property is to be used.

•          The tenant has made physical changes to the property.

•          The renter has produced damage to the rented premises.

•          The property owner wants to repair/renovate the premises.

•          The renter has issued a notice period, and the property owner has sold or accessible the house for sale.

•          The landlord has approved away, and his/her heirs have a genuine need for the property.

B. Renters must receive important maintenance services

Previously renting a property, landlords must ensure it is comfortable. The landlord is responsible for safeguarding essential maintenance services along with walls and a roof over your head. This includes a working connection for water and electricity. The utility bills generated for such services are payable by the tenant. Uniform if the tenant delays paying utility bills or the rent, the landlord cannot sever the connection. This step can only be taken by the municipal authorities or the service provider.

C. Tenants have the right to privacy in their home

Privacy is an important tenant right in India. After registration the Rent Agreement, the landlord can’t enter without a tenant’s agreement, and locks can’t be changed without a landlord’s approval. The property owner is not permitted to enter the rented portion, even with his/her spare key, except for an emergency.

D. Tenants can Refuse/Reject the Renewal of a Rent Agreement

Rent Agreements are usually for 11 months. This may be renewed as many times as required. The rental amount stated in the agreement is valid for the entire tenure and cannot be changed in between.

Property rentals are naturally raised every time an agreement is renewed. This is usually around 10% of the existing rental rate and is accessible. The tenant is under no responsibility to renew the agreement if the new rent asked for does not suit him/her.

E. Tenants are Eligible to Get a Receipt

A receipt for all payments is within tenant rights

Each month’s rent may be paid in cash, a cheque, bank transfer or any other type of legal transaction. In some cases, the preferred mode of payment may be mentioned in the Rent Agreement. Tenants can ask for a receipt; a rent receipt must show the amount paid by a renter, the date on which the property owner received the rent, and the landlord’s signature.

F. Renters must receive a Notice Period

Rent Agreement does not transfer ownership of the house to the tenant. Hereafter, the landlord can ask the tenant to move out anytime. Tenants cannot be asked to vacate the premises within a day. Property owners must give their tenants time to look for substitute accommodations. This period is tagged as the ‘Notice Period.’ Usually, a Rent Agreement stipulates a month’s notice period.

G. Tenants can fairly claim the security deposit given to the property owner

In adding to monthly rent payments, the landlord may also ask for a security deposit. This is a one-time payment. The security deposit classically equals three months’ rent, though it may be higher for furnished homes or extended leases.

H. legal heirs are entitled to your tenant rights

The Rent Agreement is signed between the primary tenant and the landlord. Though, the tenant’s family and legal heirs have the same rights as the tenants.

If a tenant dies while living in a rented house, his/her family can continue staying in the rented apartment. In such cases, the tenancy rights go to his/her inheritor.

The RERA Telangana or the Real Estate Regulatory Authority in Telangana goals to bring transparency along with effectiveness to the real estate market. RERA Telangana is accountable for real estate project listing and record maintenance for the state of Telangana. RERA Telangana became effective from July 2017, one year after the RERA Act was passed in 2016.

What is RERA Act Telangana?

The RERA Act Telangana highlights fair and transparent real estate transactions. The RERA Telangana attentions on protection the rights and interests of the buyers and sellers. •          Telangana RERA services allow free registration of real estate authorities.

•          It allows real estate agents to simply file a complaint.

How can builders get their Registration number in RERA Telangana?

Step 1: To get the RERA Telangana registration, the builder can visit the website @rera.telangana.gov.in/Home/Index and select the option of Services. 

 Step 2: Choose the Real Estate Project Registration tab, and a new window will open, and it will ask you to register on the website. It will ask you for login credentials. If the promoter is a regular user, then the promoter can enter login details and access the website. However, if the promoter is new or is the 1st time, then click on New Registration.

 Step 3: Once you create a login account. After the creation of the login id, enter the site. It will be something as below.

Here the organizer adds the details on its own. First and primary is entering the project details by the organizer. The second is adding the details of the co-promoters and project details. The project details include the number of buildings in the project, facilities, common areas, approximate project cost, and details related to project professionals.

Once the application is submitted, the documents have to be uploaded, and the registration fee has to be paid as well.

RERA Telangana Registration Documents Required

The organizer must apply to get a Telangana RERA registration number. Following are the documents needed by the promoter at the time of registration.

•          Name, photo, contact information and address of the promoter

•          Promoter's PAN Card

•          Promoter's financial statement for last years including profit & loss and balance sheet

•          Previous three years annual report

•          Project details including parking space

•          Submission of the Title deed of the plot

•          If the land is not owned by the promoter, then a collaboration agreement and development agreement is required

•          A duly filled application form for RERA registration in Telangana is needed.

•          Online payment, demand draft or cheque for paying the registration fee.

How can citizens check RERA Telangana number?

The RERA Telangana gives the home buyers the chance to guarantee that the interests and investment of the buyer are safe. The RERA Telangana urges the homebuyers not to buy flats or homes that are non-RERA approved. However, if at any point the buyer has a distrust or just want to check the credentials of a builder, they can check it on the RERA Telangana website.

  On the page above, there are numerous options available. For example, one can view the application status of the promoter or the real estate agent on the RERA Telangana site. In addition, the Telangana RERA certificate can also be seen in the search results.

How to register as a real estate agent with RERA Telangana?

As per the RERA Act Telangana, real estate agents who request to deal with or participate in the sale and purchase of real estate projects registered with RERA necessity register themselves with RERA.

Step 1: Visit the website @http://rera.telangana.gov.in/Home/Index and select services.

Step 2: Select the Real Estate Agent Registration tab. The RERA Telangana website will prompt you to register on the website, particularly for first-time users. For the existing real estate agents, they can just log in to the website.

Step 3: After registering on the RERA Telangana website, the agents can log in to their account. 

Entry or login of the real estate agent in the RERA Telangana website, the real estate agent will then have to provide personal information. This information is in terms of the Name of the agent, PAN number, Aadhar Number, Organization and Address details. The re

RERA Telangana Fee for Project Registration

The RERA Telangana has specified that the builder has to keep 70% of the amount in the bank and use it only for construction. For a housing project less than the area, 1000 sq.m, the govt will charge Rupees 5 per sq.m for registration of the project. Also, if the area is more than 1000 sq.m, then the registration charge is Rupees 10 per sq.m. However, the capping is around Rupees 5 Lakhs.

Further, in the case of a commercial plus residential project (i.e.) mixed project type, the registration cost is Rupees 10 sq.m if the land is less than 1000 sq.m and if the land is more than 1000 sq.m then a charge of Rupees 15 per sq. m is levied. However, it is being capped at 7 Lakhs.

TS RERA Directs Developers and Agents to Submit Audit Report

September 14, 2023: All the agents and developers who have own RERA certificate are demanded to submit their quarterly and yearly audit report by September end. Any party failing to submit the report will face operational action. Submitting the reports to the Telangana Real Estate Regulatory Authority is mandatory under Section 11(1)(b) and Section 4(2)(l)(D) of Provision 3 RERA Act.

The reports must be submitted using their login credentials on the Telangana RERA portal. The last quarterly report submission dates are April 15, July 15, October 15, and January 15. However the deadline for yearly reports should be submitted within six months after the annual year's end.
